1. Acceptance of Terms

By accessing or using TourMode ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

TourMode is a tour management platform for musicians, artists, and the professionals who support them. The Service provides tools for planning tours, managing shows, coordinating venues, tracking logistics, and connecting with industry professionals.

3. Accounts

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. TourMode will not be liable for any loss or damage arising from your failure to maintain account security.

You must be at least 18 years old to create an account. By creating an account, you represent that you meet this requirement.

4. Subscriptions and Billing

Certain features of the Service are available only through a paid subscription. Subscriptions are billed in advance on a recurring basis. You authorize TourMode to charge your payment method for the applicable subscription fees.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period — no refunds are issued for partial periods unless required by applicable law. TourMode reserves the right to change subscription pricing with 30 days' notice.

5. Payments

TourMode does not process or hold payments on behalf of artists or promoters. Any payment links or settlement references in the Service are informational and link to third-party payment providers. You are solely responsible for transactions conducted through those providers, and TourMode accepts no liability for payment disputes, failed transactions, or third-party terms.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe the intellectual property rights of others
  • Transmit spam, unsolicited communications, or harmful content
  • Attempt to gain unauthorized access to any part of the Service or its infrastructure
  • Scrape, crawl, or otherwise extract data from the Service without our express written permission
  • Use the Service to harass, threaten, or harm other users

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of TourMode and its licensors. You retain ownership of content you upload or create through the Service. By uploading content, you grant TourMode a limited, non-exclusive license to store and display that content solely for the purpose of providing the Service to you.

8. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct we determine to be harmful to other users or the Service. You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. TourMode does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, TourMode shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to TourMode in the twelve months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Delaware.

12. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
